Terms of Use

These Terms of Use ("Terms") govern your access to and use of 墨守 · Ink Guardian ("Ink Guardian", the "App"), provided by Christian Giusto ("Publisher", "we", "us", or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. The App

Ink Guardian is a single-player Android action roguelike game featuring gesture-based spell casting, procedural room progression, and combat gameplay.

Unless explicitly stated in the App or in an official listing, the App does not offer financial services, medical services, regulated gambling services, or custodial wallet services.

3. Eligibility

You may use the App only if you are legally permitted to do so under the laws applicable to you. If you are under the age at which you can validly accept these Terms in your jurisdiction, you may use the App only with the involvement of a parent or legal guardian.

4. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for personal, non-commercial entertainment purposes on a compatible device you control.

You may not:

• copy, sell, rent, sublicense, or distribute the App except as permitted by applicable law;
• reverse engineer, decompile, or attempt to extract source code, except to the extent such restriction is prohibited by law;
• use the App in a way that interferes with device security, platform security, or the proper operation of networks or services;
• use cheats, bots, automation, exploits, or unauthorized modifications;
• use the App for unlawful, deceptive, abusive, or harmful purposes.

5. User Conduct

You agree not to use the App to create, promote, or distribute content or behavior that:

• violates any applicable law or regulation;
• infringes intellectual property or other rights of others;
• is fraudulent, deceptive, misleading, or impersonates another person or organization;
• promotes violence, hate, harassment, self-harm, exploitation of minors, pornography, or other unlawful or clearly harmful content;
• attempts to introduce malware, exploit vulnerabilities, or gain unauthorized access to devices, accounts, software, or services.

6. Accounts and Deletion

The current version of the App is intended to function without requiring a separate in-app user account.

If we later add account-based functionality, users will be given a reasonable method to request deletion of the account and associated personal data, subject to any legal obligations to retain limited information. Deletion requests may be sent to luogodata@proton.me.

7. Virtual Items and Gameplay

The App may include unlocks, progression, scores, cosmetic or gameplay-related elements, and similar in-game features. These are licensed, not sold, unless applicable law requires otherwise.

We may update, rebalance, modify, suspend, or remove gameplay features where reasonably necessary for maintenance, security, legal compliance, or product improvement.

8. No Unlawful or Regulated Use

You may not use the App in connection with unlawful transactions, regulated activity requiring authorization, or any activity that would cause the App or its distribution to violate applicable law or platform policy.

Nothing in the App or these Terms constitutes financial advice, investment advice, legal advice, medical advice, or professional advice.

9. Intellectual Property

The App, including its gameplay systems, artwork, audio, branding, text, and software, is owned by or licensed to the Publisher and protected by applicable intellectual property laws.

Except for the limited license above, no right, title, or interest in the App is transferred to you.

10. Updates and Availability

We may release patches, fixes, content updates, balance changes, and compatibility updates. Some updates may be required for continued use of all or part of the App.

We do not guarantee that the App will always be available, uninterrupted, error-free, or compatible with every device or OS version.

11. Privacy

Your use of the App is also subject to our Privacy Policy. Please review it carefully to understand what information we collect and how we use it.

12. Third-Party Services

The App may rely on device OS features, app store infrastructure, analytics, crash reporting, or other third-party tools or services. We are not responsible for third-party services we do not control, but we will seek to use service providers in a manner consistent with applicable law and platform policy.

13. Disclaimer

The App is provided on an "as is" and "as available" basis to the fullest extent permitted by law. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.

14. Limitation of Liability

To the fullest extent permitted by applicable law, the Publisher will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, device use, or business interruption arising out of or related to the App or these Terms.

To the fullest extent permitted by applicable law, the total liability of the Publisher for all claims arising out of or relating to the App or these Terms will not exceed the greater of: (a) the amount you paid, if any, for the App in the twelve months before the event giving rise to the claim; or (b) EUR 50.

Nothing in these Terms limits liability that cannot be excluded under applicable law.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless the Publisher from claims, liabilities, damages, losses, and expenses arising out of your misuse of the App, your violation of these Terms, or your violation of applicable law or the rights of a third party.

16. Termination

We may suspend or terminate access to the App, in whole or in part, where reasonably necessary for security, legal compliance, protection of users, enforcement of these Terms, or platform compliance.

You may stop using the App at any time by uninstalling it.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy, excluding conflict of laws principles, unless mandatory consumer protection law in your country of residence requires otherwise.

Where permitted by applicable law, the courts of Italy will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the App.

18. Changes to These Terms

We may update these Terms from time to time. The updated version will be made available through the App, the listing page, or another reasonable notice method. Your continued use of the App after updated Terms become effective means you accept the updated Terms.
